1. Parties and Nature of the Agreement
This Agreement governs the use of GymTigerAI by the user ("User"). By accessing or using the application, the User agrees to be bound by these Terms.
2. Description of the Service
GymTigerAI enables profile creation, AI-powered calorie analysis, food recognition, and lifestyle tracking features.
3. License
GymTigerAI grants the User a limited, non-exclusive, non-transferable, and revocable license to use the application. Reverse engineering, resale, sublicensing, or competitive use is strictly prohibited.
4. Account & Age Rule
Users must maintain accurate account information and are responsible for all activities under their account. Use of the application is restricted to individuals aged 18 or older.
5. Fees & Subscription
Paid subscriptions are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled by the User via the respective platform. GymTigerAI does not manage or process subscription cancellations directly.
6. User Content
Users may upload images, text, and other content. By submitting content, the User grants GymTigerAI the necessary rights to process, analyze, store, and improve the service, including AI-generated outputs.
7. Prohibited Use
Users shall not upload illegal, harmful, abusive, or misleading content, impersonate others, distribute malware, misuse AI outputs for medical decisions, or violate applicable laws.
8. Intellectual Property
All intellectual property, including software, branding, AI models, and content, belongs exclusively to Aquilorix LLC.
9. Third-Party Services
GymTigerAI relies on third-party providers for cloud infrastructure, AI services, analytics, and payment processing. Use of these services is subject to their respective terms.
10. Medical Disclaimer
GymTigerAI does not provide medical advice. The application is not intended for use by individuals with chronic medical conditions, pregnancy, eating disorders, or minors. Always consult a qualified healthcare professional before making health-related decisions.
11. Warranty Disclaimer
The service is provided on an “as is” and “as available” basis, without warranties of any kind.
12. Liability Limitation
Aquilorix LLC shall not be liable for indirect, incidental, consequential damages, loss of data, or loss of profits arising from the use or inability to use GymTigerAI.
13. Termination
This Agreement terminates when the User deletes the application or violates these Terms. GymTigerAI reserves the right to suspend or terminate access at its discretion.
14. Changes
GymTigerAI may update these Terms at any time. Continued use of the application constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA.
